Telehealth Informed Consent

This document is a working baseline intended to be reviewed and customized by a licensed attorney familiar with telehealth, HIPAA, and the consumer-privacy laws of each state where EndurHealth operates (including California, Colorado, Connecticut, Virginia, Utah, and any others where you accept patients). Do not publish unmodified.
This document describes the nature of telehealth care provided through EndurHealth and the licensed medical practices that use the EndurHealth platform (the "Practice"). Please read it carefully. By submitting an assessment, completing intake, or accepting a prescription, you indicate that you have read, understood, and agreed to this consent.
1. What Telehealth Is
Telehealth involves the use of secure electronic communications — including web forms, secure messaging, audio, and (where applicable) video — to enable a licensed healthcare provider to evaluate, diagnose, and treat you remotely. Much of the care delivered through EndurHealth is asynchronous: you submit information and the provider responds within an agreed window. Synchronous (live) visits may also be offered.
2. Expected Benefits
- Convenient access to qualified medical providers without travel.
- Faster evaluation and follow-up than many in-person settings.
- Better continuity of care through digital records.
3. Possible Risks & Limitations
- Information loss: rare technical failures could delay or prevent the transmission of information.
- Lack of physical examination: telehealth providers rely on the information you submit; without an in-person exam, certain conditions may be missed or misdiagnosed. You agree to be complete and truthful in everything you submit.
- Privacy: while we use industry-standard safeguards, no electronic transmission is completely secure.
- Not for emergencies: telehealth is not appropriate for medical emergencies. If you are experiencing an emergency, call 911 or go to the nearest emergency department.
- Provider discretion: the provider may determine that telehealth is not appropriate for your situation and may recommend an in-person evaluation, decline to prescribe, or refer you elsewhere.
4. State Licensure
Providers can offer care only in states where they hold an active license. You agree that you are physically located in a state where the relevant provider is licensed at the time of each encounter. Service availability and product offerings vary by state and may change at any time.
5. Privacy & Confidentiality
Information shared during a telehealth encounter is subject to HIPAA and other applicable laws. See our HIPAA Notice of Privacy Practices for details on how protected health information (PHI) is used and disclosed.
6. Recording & Documentation
Synchronous video or audio encounters are generally not recorded. Asynchronous interactions (messages, intake forms, lab results) are stored in your medical record. You may request access to your record consistent with HIPAA.
7. Right to Withdraw Consent
You have the right to withdraw this consent at any time without affecting your right to future care. Withdrawal does not affect care already delivered. To withdraw, email privacy@endurhealth.com.
8. Alternatives
You have the right to seek in-person care from a local provider as an alternative to telehealth at any time.
9. Financial Responsibility
You acknowledge that EndurHealth services are typically not billed to insurance. You are responsible for fees as disclosed at the time of purchase. See our Terms of Service for refund and cancellation policies.
10. Acknowledgment
By proceeding to use EndurHealth services, you acknowledge that:
- You have read and understand this Telehealth Informed Consent.
- You consent to receive care via telehealth as described.
- You understand the benefits, risks, and limitations of telehealth.
- You confirm that you are physically located in a U.S. state where the treating provider is licensed.
- You understand that this consent does not guarantee any specific treatment or outcome.
