Terms of Service

This document is a working baseline intended to be reviewed and customized by a licensed attorney familiar with telehealth, HIPAA, and the consumer-privacy laws of each state where EndurHealth operates (including California, Colorado, Connecticut, Virginia, Utah, and any others where you accept patients). Do not publish unmodified.

These Terms of Service ("Terms") govern your access to and use of EndurHealth, Inc.'s website, mobile experiences, and telehealth services (collectively, the "Services"). By creating an account, submitting an assessment, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. EndurHealth Is a Technology Platform

EndurHealth is a technology platform that supports independent, licensed medical practices and pharmacies. EndurHealth itself does not practice medicine and does not provide medical advice. Medical care, prescriptions, and clinical decisions are provided exclusively by the independent providers practicing through their respective professional entities.

2. Not a Medical Emergency Service

If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. EndurHealth is not designed for urgent or emergency care.

3. Eligibility

  • You must be at least 18 years old and a resident of a U.S. state in which our affiliated providers are licensed.
  • You must have legal capacity to enter into a binding contract.
  • You agree to provide accurate, current, and complete information and to keep it updated.

4. Accounts

You are responsible for safeguarding your password and for all activity under your account. Notify us immediately at care@endurhealth.com if you suspect unauthorized use. We may suspend or terminate accounts for actual or suspected violations of these Terms or applicable law.

5. The Patient–Provider Relationship

Any patient–provider relationship is between you and the independent licensed provider, not with EndurHealth. Providers exercise independent medical judgment. They may decline to prescribe a particular medication if doing so would, in their judgment, be unsafe, inappropriate, or outside their scope of practice. Submission of an assessment does not guarantee a prescription.

6. Prescriptions & Pharmacy

  • Prescriptions, when issued, are filled through independent licensed pharmacies, not by EndurHealth.
  • Controlled substances are issued only where and as permitted by federal and state law.
  • You agree to use prescribed medications only as directed and only by the patient for whom they were prescribed.
  • Medications are shipped to addresses within the providers' licensed jurisdictions only.

7. Fees, Subscriptions & Refunds

  • You authorize EndurHealth or its payment processor to charge the payment method on file for all fees you incur.
  • Subscription plans renew automatically until cancelled. You may cancel future renewals from your account at any time.
  • Fees paid for medical consultations and dispensed medications are generally non-refundable once the consultation has occurred or the medication has shipped, except where required by law or stated in a specific refund policy.
  • Lab orders and shipping fees are non-refundable once the order has been placed.

8. Telehealth Consent & State Licensure

You acknowledge that you are receiving care via asynchronous telehealth, and you have read and accepted our Telehealth Informed Consent. Providers can render care only in states where they are licensed; service availability varies by state.

9. User Conduct

You agree not to:

  • Misrepresent your identity, medical history, or symptoms.
  • Use the Services to obtain prescriptions for a third party or to resell or divert medications.
  • Reverse-engineer, scrape, or otherwise interfere with the Services.
  • Upload viruses or malicious code.
  • Violate any law or third-party rights.

10. Intellectual Property

The Services, including text, graphics, logos, and software, are owned by EndurHealth or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes.

11. Third-Party Links & Content

The Services may link to third-party websites or contain third-party content. EndurHealth does not endorse and is not responsible for third-party sites or services.

12. Educational Content Is Not Medical Advice

Articles, lab-panel previews, symptom checkers, and the EndurHealth Science library are educational only. They are not a substitute for diagnosis or treatment by a qualified medical professional.

13. Disclaimer of Warranties

EXCEPT AS REQUIRED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENDURHEALTH AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA, ARISING OUT OF OR RELATING TO THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER. This section does not limit liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless EndurHealth and its affiliates, officers, employees, and agents from any claims, damages, or expenses arising out of (a) your use of the Services, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

16. Dispute Resolution & Arbitration

Most concerns can be resolved by contacting care@endurhealth.com. If we cannot resolve a dispute informally, you and EndurHealth agree to resolve disputes by final and binding arbitration on an individual basis under the rules of JAMS, in the state where you reside or such other forum as the parties agree. You waive the right to a jury trial and to participate in class actions, except where prohibited by law. Either party may bring a qualifying claim in small-claims court. You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@endurhealth.com.

17. Governing Law

These Terms are governed by the laws of the State of [STATE PLACEHOLDER], without regard to conflicts-of-law principles. Venue for any action not subject to arbitration lies exclusively in the state or federal courts located in [COUNTY, STATE PLACEHOLDER].

18. Changes to the Services or Terms

We may modify the Services or these Terms at any time. Material changes will be communicated by posting an updated version with a new "Last updated" date or, where appropriate, by email. Continued use after changes constitutes acceptance.
